Terms of Service

These Terms of Service govern your access to and use of Layer 8 Works.com, Layer 8 Works QR tools, contact forms, consulting services, website services, IT support services, local SEO services, network services, event-registration and ticketing-platform services, and any related technology services provided by Layer 8 Works.

By accessing this website, creating a QR code, signing in with Google, submitting a form, requesting services, paying for services, or using any Layer 8 Works service, you agree to these Terms. If you do not agree, do not use this website or our services.

1. About Layer 8 Works

Layer 8 Works provides technology services for small businesses, including website building and management, IT support, local business SEO, QR code generation and management, network implementation and support, event-registration and ticketing technology, and general IT consultation.

When Layer 8 Works provides event-registration technology for a third-party organizer, the organizer identified during the purchase process is responsible for offering and fulfilling the event.

2. Eligibility

You must be at least 18 years old to purchase paid services from Layer 8 Works. If you are under 18, you may only use the website or free QR tools with permission from a parent or legal guardian.

By using our services, you represent that you have the authority to act on behalf of yourself or the business you represent.

3. Accounts and Google Login

Some features, including the QR code generator, may require Google login. When you sign in with Google, Layer 8 Works may receive and store basic account information such as your name, email address, Google account identifier, and profile image if provided by Google.

We use this information to create your QR account, connect QR codes to your account, prevent abuse, provide support, and communicate with you about your QR codes or requested services.

You are responsible for keeping your Google account secure. Layer 8 Works is not responsible for unauthorized access caused by your lost, compromised, or shared login credentials.

4. Free QR Code Generator

Layer 8 Works may provide a free QR code generator that allows users to create QR codes for websites, Wi-Fi, contact cards, Google reviews, text, email, phone, SMS, WhatsApp, PDFs, menus, social media, payments, booking links, maps, coupons, surveys, events, app downloads, raffles, and similar uses.

Free QR codes are provided as a convenience and lead-generation tool. We may set limits on free accounts, including limits on the number of active QR codes, daily QR creation, scan analytics, hosted files, advanced features, or support.

Unless stated otherwise, free QR codes are intended to continue working, but we do not guarantee uninterrupted availability, permanent hosting, compatibility with all devices, or continued support for every feature.

5. User Responsibility for QR Codes

You are solely responsible for the QR codes you create, the destinations they point to, the content they display, and how they are used.

You agree not to create QR codes that point to or promote

Malware, phishing, scams, fraud, or deceptive websites
Illegal products, services, or activity
Harassment, threats, or abusive content
Adult, hateful, violent, or exploitative content
Spam, misleading offers, or unauthorized advertising
Payment pages or login pages designed to deceive users
Content that violates another person’s intellectual property, privacy, or legal rights
Any destination that violates applicable laws, platform rules, or these Terms

Layer 8 Works may disable, delete, suspend, or refuse to support any QR code that we believe violates these Terms, creates risk, abuses the system, or harms our business, users, or third parties.

6. QR Code Availability, Deletion, and Changes

QR codes may stop working if

You delete the QR code
The destination URL no longer works
A third-party website, app, or service changes or becomes unavailable
The QR code points to unsafe, illegal, abusive, or prohibited content
You exceed free account limits
A paid or managed service expires
There is a technical issue, hosting issue, plugin issue, DNS issue, WordPress issue, or third-party service issue
Layer 8 Works disables the QR code under these Terms

You are responsible for testing QR codes before printing, publishing, distributing, or relying on them. Layer 8 Works is not responsible for printing costs, lost revenue, lost opportunities, customer confusion, or damages caused by incorrect, expired, deleted, or broken QR codes.

7. Paid QR Management

Layer 8 Works may offer paid QR code setup, QR management, QR Care, QR hosting, QR scan reporting, QR destination updates, Google Review QR setup, menu/PDF QR setup, WiFi QR setup, booking/payment/form QR setup, or related services.

Paid QR management may include setup, testing, updates, link checks, hosted assets, reporting, troubleshooting, or consultation depending on the specific service purchased.

If a paid QR service expires, is canceled, or is unpaid, Layer 8 Works may stop providing managed updates, hosted assets, link checks, reports, support, or premium features. Where possible, we may provide notice before disabling managed features, but we are not responsible for losses caused by nonpayment, expired services, or customer failure to renew.

8. Website, IT, SEO, Network, and Consulting Services

Layer 8 Works provides website building and management, IT support, local business SEO, network implementation and support, QR management, and general IT consultation.

Unless otherwise stated in a written agreement, services are provided on a commercially reasonable best-efforts basis. We do not guarantee specific search rankings, sales, leads, website traffic, customer reviews, uptime, performance improvements, security outcomes, or business results.

For website, SEO, IT, Microsoft, Google, hosting, network, email, and third-party platform work, results may depend on customer cooperation, third-party platforms, internet providers, device conditions, software licensing, vendor policies, algorithm changes, access permissions, and other factors outside our control.

9. Customer Cooperation and Access

You agree to provide accurate information, timely communication, required approvals, account access, login credentials, administrative permissions, content, images, files, DNS access, hosting access, billing access, or other materials needed to perform the services.

Layer 8 Works is not responsible for delays, incomplete work, service limitations, or performance issues caused by missing information, incorrect information, lack of access, customer delay, third-party lockouts, vendor restrictions, or customer refusal to approve required changes.

You should never send passwords or sensitive credentials through insecure channels unless we specifically provide an approved method.

10. Third-Party Services

Our services may involve third-party products and platforms, including WordPress, Elementor, SiteGround, Google, Google Business Profile, Google Maps, Microsoft 365, domain registrars, hosting providers, payment processors, email marketing tools, SMS providers, QR services, analytics tools, routers, firewalls, access points, and other vendors.

Layer 8 Works does not control third-party services and is not responsible for their outages, pricing changes, policy changes, account suspensions, errors, security incidents, data loss, or discontinued features.

You are responsible for complying with the terms, billing requirements, and policies of any third-party services you use.

11. Payments, Billing, and Refunds

Payment terms are provided at the time of purchase, invoice, estimate, proposal, written agreement, or checkout.

Except for event registrations and unless a written agreement states otherwise, completed work, setup fees, consultation fees, emergency work, custom work, third-party costs, hosting fees, software licenses, domain fees, advertising spend, and prepaid service fees are nonrefundable to the fullest extent permitted by law.

Event registrations processed using Layer 8 Works technology are governed by the event organizer’s Event Ticket Terms, Refund and Cancellation Policy, and Privacy Notice presented before purchase. Those event-specific policies control if they conflict with the general service-refund provisions on this page.

The event organizer identified during checkout is the merchant of record and is responsible for the event, its scheduling, fulfillment, admission requirements, taxes, customer-service decisions, cancellations, and approved refunds. Layer 8 Works provides ticketing technology and may receive a disclosed online ticketing application fee.

Payments are processed by Stripe. Layer 8 Works does not receive or store complete payment-card numbers through the event-registration system.

12. Cancellations

Recurring Layer 8 Works services may be canceled according to the applicable service plan or written agreement. Cancellation does not automatically create a right to a refund for work already performed, third-party charges already incurred, or prepaid periods already begun.

Event cancellations, rescheduling, attendee cancellations, no-shows, and ticket transfers are governed by the event-specific policy displayed before registration. When an organizer cancels an event, the event-specific policy will state whether the full customer payment, including applicable platform fees and taxes, will be returned.

13. Email and SMS Communications

By submitting a form, creating an account, creating a QR code, requesting services, or becoming a customer, you agree that Layer 8 Works may send transactional messages related to your account, QR codes, services, invoices, support requests, security, renewals, expirations, or important service updates.

Marketing emails may be sent only where permitted by law and may include QR tips, setup reminders, service offers, technology tips, or Layer 8 Works updates. Marketing emails should include a way to unsubscribe.

Commercial email messages must not use deceptive headers or subject lines, must include a valid physical postal address, and must provide a clear opt-out method. Opt-out requests must be honored within the required time period.

SMS marketing or automated text messaging requires appropriate consent and opt-out handling. If SMS services are offered, users are responsible for providing lawful consent and complying with applicable SMS, carrier, and platform rules.

14. Google Reviews, Reviews, and Testimonials

Layer 8 Works may help businesses create QR codes or links that direct customers to leave reviews. These tools are intended to help customers leave honest reviews.

You may not use Layer 8 Works services to create fake reviews, buy reviews, misrepresent customer feedback, pressure customers to leave only positive reviews, suppress negative reviews unlawfully, or violate platform review policies.

The FTC has taken action against fake and deceptive online reviews, and businesses should avoid fake, paid, undisclosed, or misleading review practices.

15. Raffles, Giveaways, and Promotions

Layer 8 Works may provide QR tools that can be used for raffles, giveaways, contests, customer signups, or lead capture.

You are solely responsible for ensuring that any raffle, giveaway, contest, sweepstakes, promotion, prize, email capture, phone capture, or customer marketing campaign complies with all applicable laws, platform rules, tax rules, age restrictions, alcohol rules, local regulations, and advertising requirements.

Layer 8 Works does not provide legal advice and does not guarantee that any raffle, giveaway, contest, or promotion is lawful in your jurisdiction.

16. Intellectual Property

The Layer 8 Works name, logo, website design, graphics, branding, text, QR generator design, plugin code, service materials, templates, documentation, processes, and related materials are owned by Layer 8 Works or its licensors.

You may not copy, resell, reverse engineer, redistribute, rebrand, or exploit Layer 8 Works materials without written permission.

You retain ownership of the content, business information, logos, links, files, and materials you provide, but you grant Layer 8 Works permission to use them as needed to provide services.

17. User Content and License

When you submit content, files, links, business information, QR destinations, images, reviews, forms, or other materials to Layer 8 Works, you represent that you have the right to provide and use that content.

You grant Layer 8 Works a limited license to use, store, process, display, modify, publish, or transmit your content only as needed to provide the requested services, operate the website, maintain QR codes, provide support, and comply with legal obligations.

18. Security and No Guarantee

Layer 8 Works uses commercially reasonable efforts to provide secure and reliable services. However, no website, QR system, email system, network, software, device, or online service is completely secure or error-free.

We do not guarantee that our services will prevent every outage, hack, malware infection, phishing attempt, data loss, hardware failure, software bug, SEO ranking drop, business interruption, or unauthorized access.

You are responsible for maintaining backups, strong passwords, account security, software licenses, vendor accounts, and appropriate business safeguards unless a written agreement specifically states otherwise.

19. No Professional Legal, Financial, or Tax Advice

Layer 8 Works provides technology and consulting services. We do not provide legal, financial, insurance, accounting, or tax advice.

Any information related to compliance, privacy, SMS, email marketing, reviews, raffles, giveaways, terms, policies, or business processes is general information only. You should consult a qualified professional for legal, financial, tax, insurance, or compliance advice.

20. Disclaimer of Warranties

To the fullest extent allowed by law, the website, QR tools, free services, paid services, consulting, reports, recommendations, and deliverables are provided “as is” and “as available,” unless a written agreement states otherwise.

Layer 8 Works disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, error-free performance, security, accuracy, compatibility, and results.

21. Limitation of Liability

To the fullest extent allowed by law, Layer 8 Works will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost business, lost data, lost goodwill, downtime, printing costs, customer confusion, failed QR scans, lost search rankings, missed leads, device failures, network outages, or third-party service failures.

To the fullest extent allowed by law, Layer 8 Works’ total liability for any claim will not exceed the amount you paid to Layer 8 Works for the specific service giving rise to the claim during the three months before the event that caused the claim.

Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

22. Indemnification

You agree to defend, indemnify, and hold harmless Layer 8 Works, its owner, employees, contractors, vendors, and partners from any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorney’s fees, arising from:

Your use of the website or services
Your QR codes or QR destinations
Your content, links, files, or business materials
Your violation of these Terms
Your violation of law or third-party rights
Your misuse of email, SMS, reviews, raffles, giveaways, payment links, booking links, or customer data
Your failure to obtain proper consent or permissions

23. Suspension and Termination

Layer 8 Works may suspend, restrict, delete, or terminate access to the website, QR tools, accounts, QR codes, managed services, or support if we believe you have violated these Terms, abused the service, failed to pay, created risk, used unsafe content, submitted unlawful material, or interfered with our systems or users.

24. Changes to Services or Terms

Layer 8 Works may update the website, services, pricing, features, QR tools, limits, policies, or these Terms at any time.

The updated Terms will be posted on this page with a revised “Last Updated” date. Continued use of the website or services after changes are posted means you accept the updated Terms.

25. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules.

Before filing a legal claim, you agree to contact Layer 8 Works in writing at legal@layer8works.com and provide a reasonable description of the dispute. Both parties agree to make a good-faith effort to resolve the dispute informally for at least 30 days.

If the dispute is not resolved informally, any legal action must be filed in the state or federal courts located in North Carolina, unless the claim qualifies for small claims court. You consent to the jurisdiction and venue of those courts.

Supplemental Event Registration and Ticketing Terms

These Supplemental Event Registration and Ticketing Terms apply whenever Layer 8 Works provides event-registration, admission, inventory-management, payment-integration, confirmation, attendee-management, or related ticketing technology.

These terms supplement the general Layer 8 Works Terms of Service. Event-specific information and policies presented before purchase also apply. When an event-specific policy conflicts with these general ticketing terms, the event-specific policy controls unless applicable law requires otherwise.

1. Layer 8 Works and Event Organizer Roles

Layer 8 Works provides the technology used to display events, collect registration information, manage availability, create payment sessions, receive payment-status information, send confirmations, maintain registration records, and assist with refunds and customer support.

The business, organization, venue, or individual identified on the registration page as the Event Organizer is responsible for creating, scheduling, promoting, operating, and fulfilling the event.

Unless clearly stated otherwise

The Event Organizer is the seller and merchant of record.
The Event Organizer determines event details, capacity, admission requirements, pricing, tax treatment, cancellation rules, and refund eligibility.
The Event Organizer is responsible for honoring valid paid registrations.
Layer 8 Works is not the venue, event host, promoter, performer, or provider of the underlying event.
Stripe processes payment-card transactions.
Layer 8 Works may receive an application or online-ticketing fee from each completed registration.

For events offered by First-N-Flights Beer Wine Spirits, First-N-Flights Beer Wine Spirits is the Event Organizer and merchant of record.

The Event Organizer is responsible for the accuracy and completeness of event information. Layer 8 Works may correct formatting, typographical, or technical display errors, but does not independently guarantee organizer-supplied descriptions, schedules, requirements, availability, accessibility, or fulfillment.

3. Registration Prices and Mandatory Fees

The complete mandatory purchase price will be displayed before the buyer begins payment.

The displayed total may include

Admission or registration
Online registration or ticketing services
Payment processing
Applicable sales tax
Other mandatory charges disclosed before purchase

Layer 8 Works may receive a disclosed application fee from the transaction. That fee may be distributed automatically from the original Stripe payment and may not appear as a separate card charge.

No additional mandatory platform, service, convenience, processing, fulfillment, or similar charge will be added after the complete required price has been prominently presented, except for an optional product or service voluntarily selected by the buyer or a charge that applicable law permits to be excluded from the initially displayed total.

4. Payment Processing and Confirmation

Payments are processed by Stripe. By submitting payment, the buyer authorizes the Event Organizer and Stripe to charge the selected payment method for the displayed total.

Layer 8 Works does not receive or store complete payment-card numbers or card security codes. Stripe may provide Layer 8 Works and the Event Organizer with limited transaction information, including payment status, transaction amount, Stripe transaction identifiers, payment-method type, limited card information such as the last four digits, refund status, dispute status, and fraud or risk information.

A registration is not considered paid merely because the buyer reaches a success or confirmation page. The registration becomes paid only after the ticketing system receives and validates the appropriate payment confirmation from Stripe.

The Event Organizer’s name or statement descriptor should appear in connection with the customer’s charge because the Event Organizer is the merchant of record.

5. Availability and Temporary Holds

Event registrations are limited to the capacity established by the Event Organizer.

Beginning Checkout may temporarily reserve a registration while the buyer completes payment. A temporary reservation is not a completed purchase.

A temporary registration may be released when

Payment is declined
Checkout is abandoned
The Checkout Session expires
Payment confirmation is not received
Fraud or risk controls prevent completion
The buyer cancels payment
The transaction is reversed or invalidated

If multiple buyers attempt to purchase the final available registration, only the registration successfully reserved and confirmed through the ticketing system is guaranteed. Remaining availability may change while another buyer completes Checkout.

6. Team and Group Registrations

Some events may sell one registration for a team or group. The registration page will state the maximum number of people covered, whether only one registration may be purchased per order, whether team-member names are required, and any age or participation requirements.

The person completing a team or group registration represents that they are authorized to register the group and provide any included attendee information.

For the First-N-Flights Speed Puzzle event

One registration covers one team.
A team may include up to four players.
Only one team registration may be purchased per order.

7. Buyer Responsibilities

The buyer is responsible for

Reviewing event details before payment
Providing accurate contact and registration information
Providing a working email address and telephone number
Reviewing confirmation and event-update messages
Obtaining permission before submitting another person’s information
Ensuring attendees satisfy announced requirements
Complying with venue and Event Organizer rules
Not circumventing purchase or capacity limits
Not using the registration system fraudulently

Layer 8 Works and the Event Organizer may cancel a registration containing materially false, duplicate, abusive, unauthorized, or fraudulent information.

8. Customer-Requested Refunds

Each event is governed by the refund policy displayed before purchase.

Unless an event-specific policy states otherwise

Customer-requested cancellations and no-shows are nonrefundable except where required by law.
A refund is not automatically required because a buyer becomes unavailable, arrives late, fails to attend, or fails to satisfy an announced event requirement.
The Event Organizer decides whether to approve a voluntary refund.
Layer 8 Works may provide the technical mechanism used to process an approved refund.
Approved refunds may take several business days to appear, depending on the buyer’s financial institution.

When the Event Organizer approves a full customer refund, the Layer 8 Works application fee will also be refunded unless the event-specific policy clearly disclosed a different treatment before purchase.

When the Event Organizer approves a partial refund, the refunded portion of the application fee, if any, will be determined by the event-specific policy and the refund configuration selected by the Event Organizer.

Stripe may retain its original payment-processing charges even when the buyer receives a refund. Any processing cost not returned by Stripe is the Event Organizer’s responsibility and will not normally be deducted from a buyer’s approved full refund.

9. Event Cancellation

If the Event Organizer cancels an event and does not provide an acceptable replacement event under the published policy, the buyer will generally receive a refund of the full amount paid, including registration or admission, applicable sales tax, the Layer 8 Works application fee, and other mandatory charges included in the payment.

The Event Organizer remains responsible for funding approved refunds, Stripe fees not returned by Stripe, negative balances associated with the event, customer communications, and other cancellation duties imposed by law or contract.

Layer 8 Works is not responsible for travel, lodging, transportation, childcare, lost wages, food, or other incidental expenses resulting from an event cancellation.

10. Event Rescheduling

When an event is rescheduled, the Event Organizer may allow the existing registration to remain valid for the replacement date.

Unless the event-specific policy states otherwise, a buyer who cannot attend the replacement date may request a full refund within seven calendar days after the rescheduling notice or before the replacement event begins, whichever occurs first.

The Event Organizer must communicate material date, time, or location changes using the contact information provided during registration.

11. Registration Transfers and Resale

Registrations may not be transferred or resold unless the Event Organizer expressly permits transfers.

Layer 8 Works or the Event Organizer may reject or cancel registrations associated with unauthorized resale, duplicate purchases, automated purchasing, circumvention of order limits, fraudulent payment information, materially inaccurate attendee information, violations of event rules, or violations of these Terms.

12. Disputes and Chargebacks

Buyers are encouraged to contact the Event Organizer before initiating a payment dispute so the Event Organizer has a reasonable opportunity to review and address the issue. This does not waive any right provided by applicable law or a financial institution.

Layer 8 Works and the Event Organizer may provide Stripe, financial institutions, or payment networks with information relevant to a dispute, including registration records, event details, policy-acceptance records, confirmation messages, refund communications, device, browser, and IP information, evidence of attendance or fulfillment, and other transaction records.

A disputed registration may be suspended or canceled while the dispute is pending. Fraudulent or abusive disputes may result in refusal of future service where permitted by law.

13. Taxes

The Event Organizer is responsible for determining whether an event registration is taxable, the applicable jurisdiction and rate, required tax registrations, collection and reporting, tax remittance, exemptions, corrections, and refunds.

Layer 8 Works may provide configurable tax-calculation or reporting technology but does not provide legal, accounting, or tax advice.

14. Privacy and Registration Information

Registration information may be processed by Layer 8 Works and shared with the Event Organizer as necessary to complete the registration, manage attendance, confirm payment, manage capacity, send confirmations and updates, provide customer support, process approved refunds, prevent fraud, respond to disputes, maintain accounting and security records, and comply with legal obligations.

Registration information will not automatically be added to unrelated promotional email or text-message lists unless the individual separately provides the required marketing consent.

15. Transactional Communications

By registering for an event, the buyer consents to transactional communications reasonably necessary to administer the registration or event, including registration and payment confirmations, schedule or location changes, cancellation notices, refund updates, attendance instructions, venue or safety notices, and customer-support communications.

Consent to transactional communications does not constitute consent to unrelated marketing email or marketing text messages.

16. Event Organizer Responsibilities

An Event Organizer using Layer 8 Works ticketing technology is responsible for:

Providing accurate event information
Honoring valid paid registrations
Complying with applicable venue, safety, licensing, accessibility, consumer-protection, and tax requirements
Providing appropriate customer support
Maintaining sufficient funds for refunds and disputes
Protecting attendee information
Using attendee information only for disclosed and legitimate purposes
Promptly communicating material event changes
Applying the refund policy consistently
Responding to payment disputes
Complying with its written agreement with Layer 8 Works

17. Platform Availability

Layer 8 Works will use commercially reasonable efforts to operate and secure the ticketing platform.

The platform may occasionally be unavailable because of maintenance, hosting interruptions, internet outages, Stripe interruptions, WordPress or plugin failures, security incidents, third-party service failures, or events outside Layer 8 Works’ reasonable control.

Layer 8 Works does not guarantee uninterrupted or error-free availability. If a technical issue materially affects a registration, Layer 8 Works will use reasonable efforts to investigate and correct the registration record.

18. Event Fulfillment and Liability

The Event Organizer, not Layer 8 Works, is responsible for the event itself, including its safety, personnel, location, accessibility, quality, scheduling, admission, fulfillment, cancellation, and rescheduling.

The general disclaimers, limitation-of-liability provisions, indemnification provisions, governing-law provisions, and dispute-resolution provisions in the Layer 8 Works Terms of Service also apply to the ticketing platform.

Nothing in these terms limits a right or remedy that cannot legally be limited.

19. Policy Acceptance and Versioning

The registration form may require the buyer to affirmatively accept these Supplemental Event Registration and Ticketing Terms, the event-specific Refund and Cancellation Policy, the Privacy Policy, and any event-specific rules.

Layer 8 Works may record the acceptance date and time, accepted policy version, registration identifier, associated event, and relevant technical and security information.

The policy version accepted at the time of purchase will govern that registration unless a later change is legally required or provides the buyer with a benefit without imposing a material new obligation.

20. Contacting the Correct Party

Questions regarding an event, admission, cancellation, rescheduling, refund approval, venue rules, or event fulfillment should be directed to the Event Organizer identified on the event page and confirmation message.

Privacy Policy

This Privacy Policy explains how Layer 8 Works collects, uses, stores, shares, and protects information when you visit Layer 8 Works.com, use our QR tools, sign in to an account, submit a form, request or purchase services, register for an event using our technology, or otherwise interact with Layer 8 Works.

1. Who We Are

4. Google Login and QR Accounts

When you register for an event, Layer 8 Works shares the registration information required to administer the event with the event organizer identified on the registration page. Payment information is processed by Stripe under Stripe’s applicable terms and privacy practices. We may receive limited transaction information such as payment status, amount, payment identifier, refund status, dispute status, and the last four digits or type of the payment method where provided by Stripe.

Layer 8 Works may also use registration information to operate and secure the ticketing system, prevent duplicate or fraudulent registrations, provide customer support, maintain accounting and audit records, process approved refunds, resolve disputes, and comply with legal obligations.

Registration information will not automatically be added to unrelated promotional email or text-message lists unless the person separately provides the required marketing consent.
